Morni — Terms of Service

Last updated • May 2025

Welcome to Morni, where nature meets culture and every stitch tells a story. By visiting our website, creating an account, or purchasing a custom piece, you (“you,” “your,” “User”) agree to the following Terms of Service (“Terms”). If you don’t vibe with these Terms, please refrain from using Morni.

1. Acceptance of Terms

Using any part of the Morni platform (site, portals, or communications) binds you to these Terms, our Privacy Policy, and our Returns & Custom Orders Policy.

2. Eligibility & Account Responsibilities

You must be at least 18 years old (or have parental consent) to create an account or place an order.

Keep login details secret; you’re responsible for all activity under your credentials.

Tell us right away (support@mymorni.com) if you suspect unauthorised use.

3. Our Services

  • Morni Store – Curated, ready-to-wear designs crafted by our partner design houses.
  • Custom Co-Creation – Bring your unique vision to life through collaborative design and craftsmanship.
  • Brand Partnerships – White-label solutions for brands and businesses seeking custom collections.

From fabric sourcing to design, production, and delivery, Morni manages the entire journey of every piece we create.

4. Co-Creation & Custom Order Process

All Morni garments are custom-made through a collaborative process:

  • Design Approval: Once you approve a final sketch/design and submit your measurements, production begins. That approval is binding.
  • Made-to-Measure: Garments are crafted strictly to the approved design and the measurements you provide. Please ensure accuracy when submitting measurements—errors in measurement entry are the sole responsibility of the customer.
  • Handmade Variations: Because each piece is handmade in small batches, slight differences in color, weave, embroidery, or finish from digital mock-ups are normal and not considered defects.

By approving a design and submitting measurements, you acknowledge and accept that Morni’s responsibility is to produce according to those specifications—not to guarantee subjective fit preferences or post-production design changes.

5. Returns, Alterations & Refund Policy

Because each garment is one-of-a-kind and made-to-order:

  • We cannot accept returns, size-based exchanges, or refunds for subjective dissatisfaction (e.g., “fit feels off” or “design not as imagined”).
  • Measurement errors supplied by you are not considered defects.
  • Requests for additional design elements not included in the approved sketches cannot be added after production begins.
Exception — Manufacturing Defect
  • If your garment arrives with a significant production flaw inconsistent with the approved design and submitted measurements:
  • Notify us at support@mymorni.com within 7 days of delivery.
  • Provide clear photos and a description of the issue.
  • Once verified, we will repair or remake the garment at no cost.
Goodwill Adjustments

While not required, Morni may, at its discretion, offer tailoring credits, partial refunds, or other accommodations to ensure you’re happy with your garment.

6. Intellectual Property Rights

Morni IP — The platform, code, photos, videos, logos, and copy are Morni’s property (or licensed to us). Please don’t copy, scrape, or reverse-engineer.

Your Original Designs — You own any sketches, patterns, or artwork you submit. By uploading, you grant Morni and the matched design house a non-exclusive licence to use those assets solely for creating your garment.

7. User Conduct — The “Play Nice” Clause

You agree not to:

  • Violate any law or regulation.
  • Infringe on IP rights.
  • Upload harmful code, spam, or hate speech.
  • Harvest data from other users or the platform.
  • Misrepresent measurements, approvals, or payment details.

We reserve the right to suspend or terminate accounts that harsh the creative mellow.

8. Pricing, Payment & Taxes

All prices are listed in USD (unless stated otherwise) and exclude shipping, import duties, or local taxes.

Payments are processed securely via Stripe; production commences only after the final invoice is paid in full.

For Indian customers, GST is added as required and appears on your invoice.

9. Production Timelines & Small-Batch Variations

Estimated delivery windows are provided at checkout. Because each piece is handmade in small batches, slight variations in colour, weave, or embroidery are features, not flaws.

10. Warranty Disclaimer

Morni and its services are provided “as is” and “as available.” We make no warranties—express or implied—regarding uninterrupted service, error-free functionality, or fitness for a particular purpose. Custom garments are crafted to your approved specs; happiness with design choices is subjective and not guaranteed.

11. Limitation of Liability

To the fullest extent permitted by law, Morni’s total liability for any claim arising out of or relating to these Terms or our services will not exceed the total amount you paid Morni for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost joy, cosmic disappointment, etc.).

12. Indemnification

You agree to indemnify and hold Morni, its affiliates, and partner design houses harmless from any claim, loss, or demand (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the platform, or your infringement of another’s rights.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict-of-law principles. Any dispute you have with Morni will be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless we both agree to arbitration—or a chai-fuelled peace circle—first.

14. Changes to These Terms

We may update these Terms to reflect new features, legal requirements, or shifts in planetary alignment. If we make material changes, we’ll notify active account holders via email and update the “Last updated” date. Your continued use after changes means you accept the revised Terms.

15. Severability

If any section of these Terms is found unenforceable, the rest will remain in effect and the unenforceable provision will be replaced with a valid one that best reflects the original intent.
